Cellular Tracking/SMS Services Terms and Conditions

The primary user/account owner of the mobile phone (“Cell phone user”,”you,” or “your”) may contact Shadowtrack Technologies, Inc. (“STT.” “we,” “us,” or “our”) at any time to authorize or cancel cellular tracking or SMS services (“CTS”/”SMS”). STT uses the cell phone location coordinates (longitude, latitude, and radius-“Location Coordinates”) of the cell phone user as outlined in this cellular tracking or SMS services privacy policy.

Cancellation policy

You may cancel cellular tracking or SMS services at any time by calling the toll-free number listed in the Enrollment Agreement or by opting out during a verification call. The end user can alos reply to any text they receive with “STOP” to opt out of the SMS service.  The end user’s probation officer will be notified if they opt out of the cellular or sms service.

Cellular Tracking or SMS Services Privacy Policy

Mobile phone user privacy is extremely important to us at Shadowtrack Technologies, Inc. Location coordinates are only gathered after the mobile phone user has agreed to use this service and accepts the fees designated in the Conditions of Home Incarceration agreement. Location coordinates (longitude, latitude, and radius) will be obtained ONLY when opt-in conditions are met.

Users can opt-in to the cellular tracking or sms services via the flowing process

All users must register for Shadowtrack services and consent to allow their mobile phone location information to be used. Opt-in will be via network initiated IVR outbound or inbound call. The end user will also be able to opt-in once they receive an initial text message allowing them to reply with “Agree” to consent to the SMS service.

Cofirming consent of Cellular Tracking or SMS services

The Shadowtrack application checks for consent from the end user by checking the status of the initial consent text. If the end user does not agree to the SMS service the Shadowtrack application will no longer send SMS messages from the toll fee number.

Mobile Phone Location Data

Location data that is obtained from the wireless carriers is retained by Shadowtrack for up to 3 years, after the account is made inactive, for error handling purposes and then deleted from the Shadowtrack databases.

When will Mobile Phone Location Data be shared and with whom will it be shared

Mobile phone location information will only be used to verify that the user is located at the address allowed per the terms of their Conditions of Home Incarceration agreement or the governmental agency that has enrolled you into the program.

Important Message from your Cellular Provider (AT&T, T-Mobile, Verizon Wireless and others)

This is not a Cellular Provider application. If you use this application, it may require your Cellular Provider to disclose your customer information, including Mobile Phone Location Information, to the application provider or some other third party. By providing your consent, you authorize your Cellular Provider to disclose your information to third parties to enable this application. Check the applications’s terms of use and the policies for more information about how the application will collect, access, use or disclose your information. Terms of use and other policies usually are available on the application provider’s website. If you aren’t comfortable with the application’s policies, don’t use it. You acknowledge and agree that (1) your relationship with the application provider is separate from your relationship with your Cellular Provider; (2) your Cellular Provider is not responsible for this application; and (3) you will hold harmless your Cellular Provider and its subsidiaries, affiliates, officers, employees, agents, successors and assigns from any judgments, claims, actions, losses, liabilities or expenses arising from or attributable to this application or the acts or omissions of the application provider.

How is Mobile Phone Location information protected

Your mobile phone location information is secured in password protected databases only accessible by authorized personnel for the purpose of confirming that the your located at an allowed place during an allowed time.

Carriers Supported

Verizon Wireless, AT&T, T-Mobile and Virgin Mobile. Other carriers will be added as they become available. We also support Boost, U.S. Cellular and approximately 40% of Metro PCS phones.
